Justdeli.dk – Terms & Conditions

1. The Agreement

The agreement consists of these terms of sale, information given in the order solution and any specially agreed terms. In the event of any conflict between the information, what is specifically agreed between the parties will prevail, unless it is contrary to mandatory legislation.

When you make a purchase on www.justdeli.dk you accept our terms of purchase and a binding agreement is entered into between Justdeli.dk and you as a customer.

Buyer
The buyer is the consumer who places the order and is hereinafter referred to as the buyer.

3. Price
All prices are quoted including value added tax if this is required. The price quoted for the goods and services is the total price the buyer must pay. This price includes all fees and additional costs. The buyer shall not bear additional costs if the buyer has not been informed about any additional costs in advance.

 

We reserve the right to price changes and price errors on our products.

Offers apply as long as stock is available and we make reservations about errors in our inventory.

Discount codes and offers apply only at regular prices, and not on already discounted items. We reserve the right to cancel orders where an error has occurred.

4. Entering into an Agreement
The Agreement is binding on both parties once the buyer has sent the order to the seller.

However, the Agreement is not binding, if there is a typing or typing error in the offer from the seller in the ordering solution in the online store or in the buyer's order, and the other party realized or should have realized that there was such an error.

5. Payment

The seller may claim payment for the item from the time it is shipped from the seller to the buyer.

If the buyer uses a credit or debit card on payment, the seller can reserve the purchase price on the card when ordering. The card will be charged the same day the item is shipped. The Baking Deli ApS uses safe payment methods from Shopify.

6. Delivery and shipping
Delivery is made when the buyer, or his representative, has taken over the item. If delivery time is not stated in the ordering solution, the seller shall deliver the goods to the buyer without undue delay and no later than 30 days after the order from the customer. The goods must be delivered to the buyer unless otherwise agreed between the parties.

The Baking Deli ApS uses Dao 365 for deliveries to EU countries and GLS to Norway. Normal delivery time is 3-7 business days.

7. The risk of the item

The risk of the goods passes to the buyer when he/she, or their representative, has the goods delivered in accordance with point 6.

8. Cancellation

Unless the Agreement is exempt from the right of cancellation, the buyer may regret the purchase of the goods in accordance with the right of cancellation.
The buyer must notify the seller of the right of withdrawal within 14 days from the deadline starts. The calendar includes all calendar days. If the deadline ends on a Saturday or public holiday, the deadline is extended to the nearest working day.
The withdrawal period is considered to be complied with if a message is sent before the expiry of the deadline. The buyer has the burden of proof that the right of withdrawal has been exercised, and the notification should therefore be made in writing (e-mail or letter), with confirmation from the seller that the message has been received.
When purchasing individual items, the withdrawal period will run from the day after the item(s) is received. If the purchase consists of several deliveries, the withdrawal period will run from the day after the last delivery is received.

The withdrawal period is extended to 12 months after the expiry of the original deadline, if the seller does not state, prior to the conclusion of the Agreement, that there is a right of withdrawal and a standardized withdrawal form. The same applies if there is a lack of information on conditions, deadlines and procedures for exercising the right of withdrawal. However, if the seller provides the information during these 12 months, the withdrawal period expires 14 days after the date the buyer received the information.

When using the right of withdrawal, the item must be returned to the seller without undue delay and no later than 14 days from notification of use of the right of withdrawal is given. The buyer covers the direct costs of returning the item, such as return shipping.
In order to recover the full amount of the right of withdrawal, the item must be returned in the same condition as when you received it. The original packaging must be intact and without any tears / marks.

Note that there are special provisions in the Right of Repeal relating to timely benefits and goods that deteriorate rapidly, such as certain foods, where the general withdrawal period does not apply. Pursuant to section 22 of the Right of Repeal, the right of withdrawal does not apply to Agreements on:

  • Delivery of goods that are deteriorating or expiring quickly, 22 b);
  • Delivery of sealed goods which, for reasons of health care or hygiene, are not suitable for return and where the seal has been broken after delivery, § 22 g);

If you cancel all or part of the purchase, you will be refunded the value of the goods at the time of purchase, within 14 days of receiving and processing your return.

9. Terms of delivery

We strive to deliver your order as soon as possible. Delivery times are normally 3-7 business days, but certain destinations may take longer time. We reserve the right for longer delivery times during periods of heavy traffic at Quality Europe ApS and/or our partners for shipping.

If Quality Europe ApS does not deliver the goods at the time of delivery, the buyer shall encourage Quality Europe ApS to deliver within a reasonable additional deadline for fulfillment. If Quality Europe ApS does not deliver the goods within the additional deadline, the buyer can cancel the purchase.

As a customer, you are obliged to monitor the status of your shipment. The Baking Deli ApS is not responsible for the delivery of notification of arriving parcels. If you have not received your package within 4 weeks you are obliged to inform Quality Europe ApS of this, your order is considered to be delivered after 4 weeks.

Please note that you must pick up the goods at the post office / postal store in order to use the right of withdrawal. Packages that are returned to The Baking Deli ApS because they have not been picked up or denied at delivery by the buyer, without any reason, the buyer will not be refunded any amount for the order.

10. Defects - the buyer's rights and the time limit for the complaint

If there is a defect in the item, the buyer must within a reasonable time after it was discovered or should have been discovered, notify the seller that he or she will invoke the defect. The buyer has always advised in time if it happens within 14 days from the defect was discovered or should have been discovered. 

Please note that if the item is used abnormally or not for proper use, no complaint will be accepted. Remember that foods often have a different shelf life than other goods. Even if the complaint deadline is met, there must still be a shortage of the food product at the time of purchase in order for the conditions for the complaint to be met.

If the item has a defect and this is not due to the buyer or circumstances on the part of the buyer, the buyer may, according to the rules in the Consumer Purchase Act, Chapter 6 withhold the purchase price, choose between the correction and the delivery, demand a price reduction, demand the Agreement canceled and / or demand compensation from seller.

Complaints to the seller should always be made in writing to info@justdeli.dk.

11. The seller's rights in the event of the buyer's default

If the buyer fails to pay or fulfill the other obligations under the Agreement or the law, and this is not due to the seller or circumstances on the part of the seller, the seller may, according to the rules in the Consumer Purchase Act, chapter 9 withhold the goods, demand fulfillment of the Agreement, demand the Agreement canceled and claim compensation from the buyer. The seller may also, according to the circumstances, be able to claim interest on late payment, collection fees and a reasonable fee for uncollected goods.

Fulfillment

The seller can maintain the purchase and demand that the buyer pay the purchase price. If the item is not delivered, the seller loses his right if he waits unreasonably long to promote the claim.

12. Warranty

Warranty given by the seller or manufacturer gives the buyer rights in addition to those the buyer already has under mandatory law. A guarantee therefore does not impose any restrictions on the buyer's right to complaint and claims in the event of delays or deficiencies in accordance with clauses 9 and 10.


13. Conflict Resolution

Complaints are addressed to the seller within a reasonable time, cf. paragraphs 9 and 10. The parties shall endeavor to resolve any disputes in amicable terms. If this fails, the buyer can contact the Consumer Council for mediation.


14. Product Information

Quality Europe ApS makes reservations about errors in the stated product information.
